Omkara Empresarial S.C. who hereinafter will be referred to as «THE RESPONSIBLE» or indistinctly as «OMKARA», for the purposes of the Federal Law on Protection of Personal Data Held by Individuals hereinafter «LFPDPPP», with address in Nance 1438-B, Col. Del Fresno 1ra Sección, Guadalajara, Jalisco, 44900, you inform you: That by virtue of article 17 section II of the LFPDPPP, the data collected by OMKARA due to the nature of the services it offers will be treated with the following purposes:

1. Offer all kinds of business consulting services, including but not limited to, such as recruitment and selection, human resources processes, indicators, audits, sales, organizational, strategic, legal, operational, financial, coaching, marketing advice, professionalization of family businesses, brand development, business creation services, business training among others and that OMKARA can offer where the various areas of OMKARA may have access in order to provide the service you have requested.
2. Exchange non-sensitive data with various companies for the diffusion of their services or products in order to be published in various media that help you place them with third parties.
3. Ensure correct treatment.
4. For compliance with the policies and the service provision contract entered into with OMKARA.

Due to the above and to comply with the stated purposes, the following personal data will be requested:

• Full name
• Business name
• Email
• Address
• Phone number
• Civil status
• Gender
• Birthdate
• Financial data
• Personal and business references

As stipulated in the above, OMKARA undertakes that the treatment will be essential for the purposes mentioned and to treat them at all times under appropriate security measures to protect the confidentiality of the same and in the event that OMKARA requires them for a purpose other than that stipulated in the preceding paragraphs, your authorization will be requested and the modification to the respective Privacy Notice will be carried out.

Similarly, OMKARA has designated Carla Alejandra Muñoz de Cote Castro as the person in charge of personal data, through whom you and in accordance with the LFPDPPP, may request through email cmunoz@omkara.mx the exercise of your rights of access, rectification, cancellation and opposition, hereinafter «ARCO RIGHTS», being in charge of following up on your request and providing you with a response within 30 (thirty) calendar days of receiving your request. Likewise, the procedure for your ARCO RIGHTS will be carried out in accordance with the following:

• Full name and address.
• Identification that proves your identity (IFE, Professional ID or Migratory Document).
• A clear and precise description of the personal data with respect to which you wish to exercise your ARCO RIGHTS, what you wish to exercise and your reasons for exercising them.
• Any information or document that proves that your personal data is in OMKARA’s possession.
• In case of requesting rectification, the documentation supporting such request must be submitted.

The person in charge will respond to your request via email or in person at Nance 1438-B, Col. Del Fresno 1st Section, Guadalajara, Jalisco, 44900, within 30 (thirty) calendar days from the date the acknowledgement of receipt of the request is sent. If the request complies with the requirements requested by OMKARA, the response may be sent via email or in person.

Similarly, when the request for the exercise of your ARCO RIGHTS is appropriate and actions have been carried out by OMKARA to verify that the data provided in the request are true, the terms to carry out such request will be as follows:

• For data access: Within 30 (thirty) calendar days from the response.
• For the rectification of the data: Within 30 (thirty) calendar days from the response.
• For cancellation or opposition of data: OMKARA will make a first blocking of the same, and will have a period of 30 (thirty) calendar days to cancel the same. OMKARA may deny the exercise of the ARCO RIGHTS in the following cases:
• When the applicant is not the owner and does not accredit his or her personality with the one he or she claims.
• When your data is not in OMKARA’s database.
• When the rights of a third party are violated.
• When there is a judicial resolution or legal impediment that restricts the ARCO RIGHTS.
• When the data has been cancelled.

The exercise of the ARCO RIGHTS will be free of charge within periods of 12 (twelve) months after any of your ARCO RIGHTS have been exercised, however, if you make two or more exercises of your ARCO RIGHTS in a period of less than twelve months, the costs will be 10 (ten) days of general minimum wage in force in Jalisco. The provisions of this paragraph are excepted when it is necessary to make substantial modifications to the Privacy Notice that motivate individuals to exercise their ARCO RIGHTS.

MODIFICATIONS TO THE PRIVACY NOTICE

OMKARA reserves the right at any time to make changes or updates to this Privacy Notice, in the understanding that any changes to it will be made known to you through the publication of a privacy notice on the OMKARA website, so we recommend you check it frequently. Such modifications or updates will be made at all times attached to the LFPDPPP and in compliance with it.

In case of any contingency that violates the security of personal data in any of its phases that significantly affects your economic or moral rights, OMKARA will immediately inform you of such contingency by email or phone call, where you will be requested to be present at the address of THE RESPONSIBLE so that the causes are explained to you and you take the necessary measures to defend your rights.
